1.Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Regisara, a brand of The Nelson M Group LLC ("Regisara," "we," "us"). They govern your use of regisara.com and related services, such as email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. If you do not agree to them, you should not use the Services.

2.What Regisara is, and is not

Regisara is an information service. We publish general, plain-language information about how clinical research works, how to read a study listing, what informed consent means, and which questions to ask a study team, and let visitors opt in to related updates. We do not give medical advice, diagnosis, or treatment, do not run, recruit for, or enroll people in clinical studies, and do not match or refer people to studies or research sites, and we never share your details with study sponsors, research sites, recruiters, pharmaceutical or device companies, lead-generation companies, or any other partners.

• Decisions about your health and about taking part in any research are yours. Reading our content does not obligate you to do anything.
• Your doctor and the study team, not Regisara, decide whether a study is right for you and explain its risks, procedures, and conditions.
• Every study is different. We never guarantee that any study is safe, suitable, or open to you, or that you will qualify for or benefit from any research.

3.Eligibility

Use of the Services requires that you be at least 18 years of age, based in the United States, and legally able to contract. You may submit details solely about yourself or about someone who has authorized you to act for them.

4.Your information and accuracy

Please keep the details you give us correct and current. Enter a mobile number only if you own it or are authorized to use it. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

5.Communications and text-message consent

If you choose to opt in, you consent to being contacted by email and, if you tick the boxes that apply, by automated text messages as set out in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. • STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 888-669-3612.

7.Acceptable use

In using the Services you agree that you will not (a) supply false, misleading, or someone else's data, (b) engage in unlawful, fraudulent, or abusive conduct, (c) interfere with, disrupt, or try to gain unauthorized access to the Services, (d) use bots or automated methods to submit forms, (e) copy, scrape, or resell our content without permission, or (f) impersonate any person or entity. We may suspend or end access for violations.

8.Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for example government agencies, hospitals, or patient organizations) are third-party operations. No product, plan, or provider is endorsed by us, and we have no responsibility for the conduct, content, or results of those third parties. Your relationship with any doctor or study team is between you and them.

9.Intellectual property

The Services, including the Regisara name, logo, text, graphics, and design, are owned by us or our licensors and covered by intellectual property laws. Your license to view and use the Services is limited, revocable, non-exclusive, and non-transferable, and is for personal, non-commercial reasons. Site photographs are used under their respective free-use licenses.

10.Disclaimers

The services and all content are offered "as is" and "as available," with no warranty of any kind, express or implied, among them any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We make no promise that the services will run without interruption or error, be secure, or that messages will arrive, or arrive on time.

Regisara does not provide financial, legal, or tax advice, and makes no representation about any medical outcome, study result, or eligibility.

11.Limitation of liability

As far as the law allows, Regisara and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health or research decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

In jurisdictions that do not allow certain limitations, those limitations may not apply to you. These Terms never limit liability that the law says cannot be limited.

12.Indemnification

You will indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel for any claims, damages, and expenses, including reasonable attorneys' fees, resulting from your violation of these Terms, misuse of the Services, or provision of a phone number or other information you were not authorized to give.

13.Disputes, governing law, and arbitration

Informal resolution first. Please contact us at [email protected] and let us try to resolve it within 30 days.

Binding arbitration. Except where a matter belongs in small claims or involves injunctive relief for intellectual-property misuse, you and Regisara or The Nelson M Group LLC agree that any dispute arising out of or relating to these Terms or the Services will be decided by final, binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in your county of residence or by video or phone, as you select. The arbitrator may award the same individual relief as a court, and judgment can be entered in any court of competent jurisdiction.

Class-action waiver. To the extent permitted by law, you and Regisara each agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, or representative action.

Opt-out. Within 30 days of first accepting these Terms, you may decline arbitration by emailing [email protected] with the subject "Arbitration Opt-Out", stating your name and mobile number.

Governing law. Governing law: the Federal Arbitration Act and the laws of the state in which The Nelson M Group LLC has its principal place of business, without regard to conflict-of-law rules. Except as the arbitration clause provides, exclusive jurisdiction lies with the state and federal courts located in that state.

14.Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. We may suspend or terminate access at our discretion, including for violations of these Terms. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and disputes) will survive termination.

15.Changes

From time to time we may update these Terms and will post the update with a new "Last updated" date. By continuing to use the Services after the effective date you accept the updated Terms. Notice of material changes will be supplied where needed by law.

16.General

This is the entire agreement between you and us on this subject: these Terms plus the Privacy Policy and SMS Terms. The remainder survives if any part is unenforceable; failing to enforce a provision does not waive it. You need our consent to assign these Terms, while we may assign them in a merger or a sale of the business.
